Welcome to Practice MCAT ("we", "our", or "us"). These Terms and Conditions govern your access to and use of our mobile application (the "App") and the services we provide, which include educational content, practice tests (MCQs, Long Exams), mind maps, flashcards, video lessons, and live chat support for the Medical College Admission Test (MCAT).
Please read these Terms carefully before using the App. By downloading, installing, or using Practice MCAT, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must not use our App.
1. Eligibility and User Accounts
1.1 Account Creation
To access the core features of the App, you must register for an account using a valid email address and password, or through third-party authentication services (such as Apple Sign-In). In doing so:
- Accuracy: You agree to provide accurate, current, and complete information during registration.
- Security: You are responsible for safeguarding your password and any other credentials used to access your account. You agree not to disclose your password to any third party and to notify us immediately if you suspect unauthorized use of your account.
- One Account Policy: You may only create one account per individual user. Sharing accounts between multiple individuals is strictly prohibited and may result in immediate suspension or termination of your account without a refund.
1.2 Eligibility
Our services are directed toward students preparing for the MCAT. You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use our App. If you are under the age of 18, you confirm that you have obtained the consent of a parent or legal guardian to agree to these Terms.
2. Pro Membership and Subscriptions
Practice MCAT operates as a "Freemium" model. Certain advanced features, such as answers/explanations to 50,000+ MCQs, full-length tests, topic videos, and mind maps, are available exclusively through our Pro Membership subscription.
2.1 Billing and Subscriptions
Subscriptions are managed through your Apple ID account (or Google Play account, where applicable) using a secure third-party provider (RevenueCat).
- Payment: Payment will be charged to your App Store account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew at the end of the current billing period (e.g., Monthly or Yearly) unless auto-renew is turned off at least 24-hours before the end of the current period.
- Management and Cancellation: You may manage your subscriptions and turn off auto-renewal by going to your App Store Account Settings after purchase. If you cancel your subscription, you will retain access to Pro features until the end of the current billing cycle. We do not process cancellations or refunds directly; these are handled solely by Apple.
2.2 Pricing Changes
We reserve the right to modify the pricing of our subscriptions at any time. Any price changes will apply to your next billing cycle following notice of the change, in accordance with App Store policies.
2.3 Free Trials
We may occasionally offer a free trial period (e.g., a 7-day trial). If you sign up for a free trial, you may be automatically charged the subscription fee at the end of the trial period unless you cancel it via your device settings at least 24 hours prior.
3. Intellectual Property Rights
3.1 Our Content
All content available within the App, including but not limited to the 50,000+ multiple-choice questions, tests, videos, mind maps, flashcards, UI designs, code, logos, and written text (collectively, "App Content"), is the exclusive property of Practice MCAT and its licensors.
3.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App and App Content strictly for personal, non-commercial, educational purposes.
3.3 Restrictions
You explicitly agree NOT to:
- Copy, reproduce, distribute, or publicly display any App Content without our prior written permission.
- Scrape, "data-mine", or manually bulk-download our questions, videos, or study materials.
- Sell, rent, lease, or sub-license our content.
- Modify, reverse engineer, or decompile any part of the App.
4. User-Generated Content (Live Chat)
Our App features a Live Chat support module where users can message tutors, ask questions, and upload images.
4.1 Acceptable Use
By engaging with our Live Chat or any other user-generated functionality, you agree that you will not submit, transmit, or upload any content that:
- Is offensive, hateful, abusive, threatening, or harassing.
- Is sexually explicit or pornographic.
- Infringes on the intellectual property rights of any third party (e.g., uploading copyrighted exam material not belonging to us).
- Contains malware, viruses, or spam.
4.2 Our Rights
We reserve the right to monitor communications in the Live Chat (using Appwrite databases and storage) to ensure compliance with these Terms. We may remove any content or terminate your access to the Live Chat or your account, at our sole discretion, if you violate these rules.
5. Educational Disclaimer & Limitation of Liability
5.1 No Guarantee of Results
Practice MCAT is an educational tool designed to assist you in preparing for the Medical College Admission Test. However, we do not guarantee any specific test score, admission to any medical school, or any particular academic outcome.
- While we strive to ensure the accuracy of our questions and explanations, some errors may occur. You agree to use the App Content at your own risk.
5.2 Disclaimer of Warranties
The App is provided on an "AS-IS" and "AS-AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components (though we use robust infrastructure, including Firebase Crashlytics and Microsoft Clarity, to monitor and fix bugs quickly).
5.3 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Practice MCAT, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or academic opportunities, arising from or related to your use, or inability to use, our App.
Our total liability to you for any claims arising under these Terms shall not exceed the total amount you paid (if any) to us for the App in the twelve (12) months preceding the claim.
6. Privacy and Data Collection
Your use of the App is also governed by our Privacy Policy. By using Practice MCAT, you consent to the collection, use, and sharing of your data as described in the Privacy Policy. Specifically, we collect performance analytics, crash logs, and usage behavior to enhance the learning experience.
7. Third-Party Services
The App utilizes third-party services (such as Appwrite for databases/auth, RevenueCat for purchases, and Google/Firebase for analytics). These services operate under their own Terms and Conditions. We are not responsible for the availability or functionality of these external, third-party services.
8. Modifications to Terms
We reserve the right to update or modify these Terms and Conditions at any time. If we make material changes, we will notify you within the App or via the email associated with your account. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
